The Victim
If you have been the victim of a crime, you may be entitled to legal assistance provided by a lawyer. Legal fees are paid for by the court and not the victim. You can request a specific lawyer, provided that the person you request has the credentials necessary to be appointed by the court. Your lawyer can help you secure your rights to, among other things, compensation. Your lawyer can also assist you during your interviews with the police as well as at trial.
The Suspect
If you are suspected of committing a crime, you are entitled to be represented by a court-appointed lawyer to defend you. You can request a specific lawyer, provided that the person you request has the credentials necessary to be appointed by the court. The legal fees are paid for by the court, although in some circumstances, the court can order the individual, if he or she is convicted of the crime, to reimburse the court for all or part of the legal fees if the court determines that the person has the financial means to do so. Your lawyer is present at all interviews with the police as well as at trial. Your lawyer can advise you on the best way to defend during the proceedings. In addition, if you are convicted of a crime, your lawyer can help the court decide on an appropriate penalty. For example, if the crime committed is related to substance abuse, your lawyer can take measures necessary to convince the court to choose rehabilitation instead of incarceration.
