Many people hope to someday own a horse. Buying a horse requires a significant commitment of time and money. If the horse’s condition is less than expected, the buyer often encounters substantial stress, anxiety and large unexpected expenses. Having competent legal advice throughout the process can usually lead to a satisfying result for both parties.
When buying a horse, there are no statutory formalities for the purchase. Buyers and sellers can orally agree on the horse purchase. A written purchase contract, however, is preferable for evidentiary purposes as well as to clarify the terms for the parties.
Please note that different laws apply depending on whether the seller is a private individual or trader. For example, the regulations for consumer purchases impose certain mandatory protections that can not be waived. It is therefore wise to contact a lawyer for legal advice when drawing up a purchase contract.
If the purchase leads to dispute due to the horse being in worse condition than expected, it is important to get help from someone with knowledge and experience.
