When buying real estate, cooperative apartments or condominiums, statutory requirements relating to the contract apply. If these requirements are not satisfied, the contract is invalid. In addition, statutory requirements apply to certain conditions, such as the buyer’s right to inspect the property after contract signing, or if either party wants the right to rescind if he or she doesn’t find a different dwelling. Partly due to these statutory requirements, drafting enforceable contracts requires legal expertise. If the property has defects that were not known or discoverable before the contract was signed, the parties will need legal assistance to sort out what their respective rights and obligations are.
